These terms apply to your use of asiaglobalyachting.com (the “website”), run by Asia Global Yachting (Thailand) Co., Ltd. (tax ID 0835564001918), Royal Phuket Marina, Phuket 83000, Thailand (“AGY”, “we”, “us”). By using the website you agree to them. If you do not agree, please do not use the website.
Charters are covered by separate terms. Our Charter Terms of Service and the charter agreement you sign apply to every booking. If they conflict with these terms, the charter terms take priority.
1. Information on the website
We describe yachts, itineraries and destinations as accurately as we can. Specifications, photos, availability and inclusions can change, and some information comes from yacht owners and operators. Please confirm anything important to you before booking.
2. Prices and currency
Prices shown as “from” are a starting guide. Charter rates depend on dates, guest numbers, itinerary and extras, and every booking is quoted individually. Prices in other currencies are converted for convenience only. The currency on your invoice is the one you pay in.
3. Bookings and payment
A booking is confirmed only when we confirm it in writing and receive the required deposit. Card payments are processed by Stripe under its own terms. Bank transfers must reach us in full, net of bank charges. Where a refund is due under the charter terms, payment processing fees cannot be refunded.
4. Agency role
AGY acts as agent for the owners and operators of the yachts we offer. Your charter contract is with the yacht’s owner or operator, who is responsible for operating the yacht and its crew. AGY is responsible for arranging your booking and passing on your payments and requirements accurately.
5. Accounts
If you create an account, keep your login details secure and tell us at once if you think someone else has used it. We may suspend an account that is used to break these terms.
6. Acceptable use
You must not use the website to break the law, send spam or malware, try to gain unauthorised access to our systems, or copy content from it in bulk by automated means.
7. Intellectual property
The website’s text, photos, videos, logos and design belong to AGY or its licensors, including yacht owners and photographers. You may view and share pages for personal use. Any other use needs our written permission.
8. Links to other websites
We link to other websites, such as payment and messaging providers. We are not responsible for their content or practices.
9. Liability
We provide the website “as is” and do not promise it will always be available or free from errors. To the extent Thai law allows, we are not liable for indirect or consequential loss arising from use of the website. Nothing in these terms limits liability that cannot be limited by law, including under the Unfair Contract Terms Act B.E. 2540 (1997) or for death or personal injury caused by negligence.
10. Privacy
Our Privacy Policy and Cookies Policy explain how we handle personal data.
11. Governing law
These terms are governed by the laws of Thailand. The courts of Thailand have jurisdiction over any dispute about them. If you are a consumer, this does not remove any protection you have under the laws of the country where you live.
12. Changes
We may update these terms and will show the new date at the top of this page. Changes do not affect bookings already confirmed.
